Open Source Software in the eHealth Framework

The eHealth Framework uses a variety of Open Source components, some of which have been patched:

Warranty and Liability Limitations

  1. No liability regardless of negligence or fault is assumed for the use of the ICW software. In particular, customers are not entitled to a remediation of defects. Customers shall be free to use other programmers, in particular open source developer communities on the internet, to remedy any defects.
  2. ICW’s liability for defects of title and quality are governed by Sections 523, 524 BGB. At the time the agreement is entered into, ICW shall already be in possession of the software to be provided (program code, accompanying material and any respective rights), and is therefore only liable to the customer for any damages caused by a fraudulent concealment of defects.
  3. In all other cases, regardless of the legal grounds (precontractual mutual trust, a contract, crime), ICW is only liable for damages as follows:
    - In the entire amount in the event of a transfer of a warranty with respect to the particular guaranteed condition, and in the event of intent and
    - In the event of gross negligence limited to compensation for foreseeable and typical damages.
  4. The statutory legal liability stipulated by the product liability laws and the liability for injury to life, body, or health shall remain unaffected.
